Terms of Service

Welcome to www.ignitephysio.ca (the “Website”), owned and operated by Clinical Marketing Inc. (“CMI”). By accessing and using the Website, you are agreeing to comply with and be bound by these Terms of Service in this Agreement (the “Agreement”). Please read the following Agreement carefully. If you do not wish to be bound by these terms and conditions, you may not access or use or register on the Website. CMI may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement on the Website. You agree to review the Agreement periodically to be aware of any modifications and your continued access or use of the site shall be deemed to be your acceptance of the modified Agreement.

The Website in intended for viewing, use and to promote practice-related discussions by and among physiotherapists qualified to practice in Canada, or intending to practice in Canada, including internationally qualified physiotherapists, physiotherapy students, researchers, and administrators (“PT Users”) who reside in Canada. Only PT Users may register and have access to the password-protected portions of the Website.

CMI reserves the right to display, add, edit or remove any content of the Website as it sees fit, and to terminate access of any PT User, without prior notice to any PT User.

Community Guidelines for use of the forums on the Website must be adhered to, and failure to follow those Community Guidelines will be considered a breach of this Terms of Service Agreement.

Electronic Communications

When you access and use the Website or send us an e-mail, or otherwise communicate with us electronically, you are agreeing that CMI can communicate with you electronically, and any agreements formed by electronic communication between you and CMI will be valid in that form.

PT Users’ Access

To be allowed access to the password-protected section of the Website, you must provide confirmation of your qualification as a PT User in the form as specified by CMI (the “PT Qualifications”) and CMI will only allow access to the PT-only section of the Website on acceptance of your PT Qualifications.

In the event of any change to the requirements for the PT Qualifications, as a result of: 1) change in legislation; 2) change in policy or practice by the appropriate physiotherapy regulator; or 3) for any other reason; or, in the event CMI receives confirmation that the PT User otherwise no longer possesses the PT Qualifications, CMI reserves the right to prevent access of the PT User to the PT-only section of the Website until such time as the PT User has provided, and CMI has accepted, evidence of the PT User’s qualifications under the applicable regulatory requirements.

Registration

Registration of a PT User on the password-protected section of the Website shall consist of the following entitlements:

  • Access to the password-protected section of the Website;
  • Ability to update personal profile information;
  • Ability to post and view information in the password-protected section of the Website;
  • Access to information made available at the discretion of CMI related to the posts made by the PT User, and responses thereto;
  • Access to the ignitephysio blog, and other event, educational, or resource information available in the password and non-password protected sections on the Website;
  • Ability to vote on answers of other PT Users and provide comments on other postings;
  • The entitlement to create and populate a content dashboard of Website topics and assets and follow/favourite content across the site;
  • The entitlement to use the WATT online planning tool for physiotherapists;

CMI reserves the right to reclaim and allow re-use of usernames where a PT Users’ registration is cancelled or rendered inactive.

For registered PT Users located in Alberta, CMI has agreed to provide aggregated, non-identifying data to Physiotherapy Alberta College + Association regarding use of the Website by Alberta PT Users, to allow Physiotherapy Alberta College + Association to assess the value of providing funding for enhancements to the Website for the benefit of Alberta PT Users.

Privacy

The complete privacy policy for the Website can be viewed here and you agree that you have reviewed that policy and accept notice of it.

An e-mail service provider may provide our e-mail services. E-mail is not recognized as a secure medium of communication. For this reason, we require that you do not send private or sensitive information to us by e-mail, other than in relation to required information for your PT User profile. We may use an in-app messaging system to communicate with you, and we may use email to providing you with site and content updates.

Please remember that, if you use a link to go from the Website to another website, the privacy provisions of those websites are applicable to any personal information that may be disclosed on such third party websites or services. Your activities and interaction on any other website, including websites that have a link on the CMI website, is subject to that website's own rules and policies. Please review those privacy rules and policies before proceeding.

Our servers may collect domain names and/or IP addresses of users to measure use of the Website, administer the Website, improve content and gather broad demographic information for aggregate use. We do not link IP addresses to personally identifiable information. Specific sections of the Website require the acceptance of cookies (a file placed in a user’s computer), or may contain tags or “marketing pixels” that will retain information that identifies your computer’s browser address on other websites to display focused advertising messages for you. We use cookies and similar technologies only to enhance your experience when using our site, to improve search functionality or to hold information for your convenience that you would otherwise need to re-key.

Permitted Use

As a user of the Website you may view, copy, print, share and use (collectively, "use") documents or other materials ("Documents") on the Website as specified and you agree that you will observe and comply with any notice or restriction on or accompanying any particular Document(s) or other content you wish to obtain or share from the Website.

Copyright and Trade-Marks

The original or licensed photographs, text, illustrations, documents, look and feel, identifying marks and underlying software coding found on the Website, are protected under the copyright laws or trademark laws of Canada and other countries. You are not permitted to reproduce any part of the Website without the express written permission of CMI, with the exception of normal course reproduction of postings of PT Users within the Website.

User Generated Content

Any intellectual property in opinions, original information, original documents or other original material posted by a PT User to the Website (a “Posting”) remains the property of the User/owner, and each such User grants to CMI a non-exclusive, worldwide, royalty free, irrevocable, unrestricted license, with right of sublicense, to display, publish, reproduce, edit, transmit, translate, modify, adapt, or remove any and all Postings of a User, in whole or in part, in relation to the Website.

Each PT User acknowledges that all other PT Users are entitled to reproduce and critique Postings in the normal course of use of the Website, and that Question Titles will be subject to access and display by search engines, outside of the control of CMI.

You agree and acknowledge that by asking questions and providing answers as part of Postings, you may be identified by your first and last name in the Postings, and by certain other information in your registration profile, if that requirement is implemented by CMI for use of the Website.

CMI reserves the right to retain and continue to make the uses permitted above of any or all Postings by a registered PT User, even if the PT User’s registration is cancelled or inactivated by CMI or by the PT User.

PT Users shall not post any personal information about patients, co-workers or other third parties in any Postings.

Restrictions and Prohibited Uses

You agree that you will not use the Website for any improper, fraudulent, illegal or malicious purpose, including, without limitation, to impair use of the Website by others.

You agree not to modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover the source code of the Website, or to gain access to password protected sections other than through registration on the Website. You also agree not to develop any similar or competing business or website that uses any portion of, or look and feel of the Website, or any of the Documents.

You agree that you will not post, or encourage others to post any infringing, defamatory, degrading or otherwise offensive material on the Website.

Where you have password-protected access to the Website as a result of being a PT User or employee of a PT User, you shall not disclose such password to any persons not authorized to have PT User access to the Website.

Hyperlinks

The Website may contain links to third party websites. These links have been provided solely as a convenience for you and do not constitute an endorsement by CMI of the content of such third party sites. Where these links are for the purposes of completing transactions (such as a third party payment services) you are subject to whatever terms are required by that third party, and CMI is not responsible for any failure by the third party to make you aware of such terms, or for your failure to be aware of such terms.

Links to the Website may also be provided from sites either known or unknown to CMI. Access to any other web site linked to or from the Website is at your own risk. CMI has not reviewed and is not responsible for the content of any third party sites linked to or from the Website and does not make any representations or warranties regarding the content or accuracy of materials on such third party websites.

Restriction of Access

CMI reserves the right to restrict or refuse access to the Website to any person or organization, including a PT User, where CMI, in its sole discretion, determines such person or organization is in violation of the terms of this Agreement, or otherwise poses a risk to the integrity, reputation, or operation of the Website or of CMI.

Disclaimers and Limitations

The Website, the Postings, and the other information and documents therein are provided or made available by CMI on an “as is" and "as available" basis. PT Users expressly agree that use of the Website and submission of registration and the content therein is at the User’s sole risk. CMI disclaims any liability for any claims, actions, costs or damages that may be brought or arise from: the treatment or non-treatment of any member of the general public; any privacy breach committed by a PT User; any claims for defamation or intellectual property infringement, based on use of, or information found on, the Website, and each PT User agrees to indemnify and hold harmless CMI, it’s directors, officers and employees, from any against any such claims, actions, costs or damages, including but not limited to, direct, indirect, incidental, punitive, and consequential damages arising from such actions or omissions of that PT User.

Without limiting the generality of the foregoing, and to the full extent permissible by applicable law, CMI disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. CMI makes no representations or warranties of any kind, either express or implied, as to the operation of the Website or any aspect of the information, content, materials, documents or products and services included on the Website, including as to whether the Website, its servers, or e-mail sent from CMI or its authorized agents are free from viruses or other harmful components. CMI does not warrant that access to the Website will be continuous or will be available at any given time, nor that any content of the Website will remain available for access. CMI will not be liable for any damages of any kind arising from the use of the Website or content thereof, including but not limited to, direct, indirect, incidental, punitive, and consequential damages.

The laws of certain jurisdictions do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you in your jurisdiction, some or all of the above disclaimers, exclusions, or limitations might not apply to you, and you may have additional rights.

Governing Law and Jurisdiction

By accessing and using the CMI website, you agree that the laws of the Province of Alberta, Canada, without regard to principles of conflict of laws, will govern this Agreement and any dispute of any kind that might arise between you and CMI or its affiliates. For Quebec PT Users, you agree that this Agreement and all documents relating thereto shall be created in English only.
